 Locate Order Occupy and Parking Technologies Inc. and its affiliates (“Loop,” “we,” “us,” or “our”) offers marketing services (“Marketing Services”) regarding the location and potential availability of certain parking spots (“Parking Spots”) to users of www.loopparking.ca and associated software application(s) (the “Site”). In so doing, we market the Parking Spots on the Site and facilitate the swap or reservation (“Reservations”) of Parking Spots between users of the Site (“you,” “your”) and owners, hosts, lessors, managers or operators of Parking Spots (“Licensors”).

Loop values individual privacy rights and wants to give you and other visitors and users of our Site the opportunity to understand the kind of information that we collect about you and how you can limit the use of personally identifiable information to those purposes for which it has been authorized, as detailed in the following privacy policy, This Privacy Policy also describes Your privacy rights and how the law protects You.

We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to as Locate Order Occupy and Parking Technologies Inc. or Loop Parking or Loop Parking App or Loop App. Registered office at 214 Tilley Road, Sault Ste. Marie.

  • Country refers to: Ontario, Canada

  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

  • Personal Data  is any information that relates to an identified or identifiable individual.

  • Site: Our Websites and associated software application(s)

  • Service refers to all the services provided through our Site.

  • Reservations refer to reservations or swaps of parking spots with or without the use of sensors.

  • Licensors mean owners, hosts, lessors, managers or operators of Parking Spots

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

When You access the Service by or through any devices, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through any devices.

 

Information Collected while Using the Application

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:

  • Information regarding your location or your current location, With your permission (i.e. if authorized through the permission system used by your mobile operating system or you make the affirmative decision to permit location tracking on our website), location information, including, the precise location of your device when the app is running or when you are using our ‘search nearby’ feature;

  • Pictures and other information from your Device's camera and photo library

  • Vehicle information such as license plate information, make/model/year of your vehicle.

  • Information including, but not limited to, Parking spot images, availability, and parking spot address regarding your private or residential parking spot.

  • Depending on the service used, sometimes financial information, such as credit card or bank account numbers may be collected by our 3rd payment processor, Stripe (https://stripe.com/en-ca/privacy);

 

We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device.

You can enable or disable access to this information at any time, through Your Device settings.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide, personalize, and improve your experience with our Services and our advertising made available on or outside the Service;

  • To provide and maintain our Service, including to monitor the usage of our Service.

  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.

  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.

  • To facilitate payment processing through our third-party payment processor (Stripe) or prevent or detect fraud; To manage Your requests: To attend and manage Your requests to Us.

  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

  • Location information, to calculate distance to available Parking Spots;

  • To enforce this Privacy Policy, the Terms and Conditions, and any other terms that you have agreed to, including to protect the rights, property, or safety of Loop Parking, its users, or any other person, or the copyright-protected content of the Marketing Services;

We may share Personal Information with parties who provide services such as information processing, payment processing (Stripe) extending credit, fulfilling customer orders, delivering products, managing and enhancing customer data, providing customer service, assessing interest in our products and services, and conducting customer research or satisfaction surveys. Except as otherwise set forth in this Privacy Policy, we only share Personal Information to provide or improve our products, services and advertising, nor will we share your Personal Information with third parties for their marketing purposes. We provide certain Personal Information to Licensors in order for such Licensors to, among other things, provide their services in connection with facilitating Reservations, confirm your Reservation on-site, and for the Licensors’ own business uses, including marketing to you. Licensors’ use and sharing of your Personal Information will be subject to each Licensor’s privacy policy. Loop is not responsible for any Licensor’s use or sharing of your information. We may disclose any collected information, including personally identifiable information, if: (1) the disclosure is necessary or useful to our provision of services; (2) we believe in good faith that disclosure is necessary to protect our rights, interests, or property; (3) we are acting in good faith to protect your safety or the safety of others, to investigate fraud, or to respond to a government request; (4) we believe in good faith the disclosure is required by law, such as to comply with a subpoena, search warrant, court order, or similar legal or administrative process; and (5) a third party purchases or otherwise acquires us or the Site, in which case your information will likely be among the assets transferred.

We may also share Your personal information in the following situations:

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You.

  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.

  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy.
